Karnataka HC remains BAI’s turn against KBA

The Karnataka High Court has stayed the Badminton Association of India (BAI) decision to bar the Karnataka Badminton Association (KBA) from membership.
The BAI had sent a letter to KBA on July 13 excluding it from membership, citing KBA’s failure to comply with the amendment to its Articles of Association to align it with the BAI Statutes.
Judge SG Pandit heard the KBA’s appeal.

Counsel for the KBA submitted that the “Issued letter excluding the petitioner herein violates the principles of natural justice and no notice is issued.
“The Government Attorney for the Department of Youth Development and Sports of the Karnataka Government informed the court that “The Karnataka Badminton Association has not amended the Articles of Incorporation in accordance with the National Sports Development Code of India, 2011.”
The HC said: “Upon review of the contested letter, it would not indicate or disclose the issuance of a notice prior to resignation from the Karnataka Badminton Association.
The matter needs to be looked into.” Therefore, the said letter was stayed and the defendants were given two weeks to submit a statement of objections. An urgent notice has been sent to the Government of India, the Government of Karnataka, BAI and the Department of Youth Development and Sport. Karnataka.
